Terms and Conditions of the Retrowood.pl Online Store

Effective from: 01.01.2015

1. Definitions

  • Online Store – the store available at https://retrowood.pl.
  • Seller – Retrowood Sp. z o.o., ul. Malborska 41, 03-286 Warsaw, NIP: 5372622841.
  • Client – a natural person, legal person or an organizational unit without legal personality, which is granted legal capacity by law, concluding an agreement with the Seller.
  • Consumer – a natural person who, in relations with the Seller, performs a legal act not directly related to their business or professional activity.
  • Goods – a product, a movable item, which the Client purchases via the Online Store.
  • Order form – a form available in the Online Store enabling the Client to make a purchase.
  • Complaint/return form – a form available in the Online Store enabling the submission of a complaint or withdrawal from the contract.
  • Voucher – a value voucher issued by the Seller, entitling the holder to make purchases in the Online Store within the scope indicated on the voucher.

2. General provisions

  1. These Terms and Conditions define the rules for using the Online Store, including the conclusion of sales contracts, order processing, payments, delivery, withdrawal from the contract and the complaint procedure.
  2. The Online Store sells furniture and products made of reclaimed wood and natural materials.
  3. The information about Goods published on the Online Store website does not constitute an offer within the meaning of the Civil Code, but an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
  4. These Terms and Conditions are made available free of charge on the Online Store website in a manner that allows their acquisition, reproduction and recording.

3. Provision of electronic services

  1. The Seller provides services electronically by enabling Clients to place orders via the order form and to contact the Seller by e-mail.
  2. These services are provided free of charge.
  3. The Client may discontinue using the electronic services at any time, which results in termination of the agreement for their provision without the need to submit an additional statement.
  4. To use the Online Store, it is necessary to have a device with Internet access, a web browser and an active e-mail account.

4. Placing orders

  1. The Client places an order by selecting the Goods, their variants and quantity, and then completing the order form.
  2. Before placing an order, the Client has the opportunity to read these Terms and Conditions and accept them by ticking the appropriate checkbox in the order form.
  3. The sales contract is concluded at the moment when the Client receives from the Seller an e-mail confirming acceptance of the order for processing, sent to the e-mail address provided by the Client.

5. Payments

  1. Available payment methods:
    • bank transfer,
    • online payment via Przelewy24,
    • instalments via Credit Agricole Bank Polska S.A.
  2. The Client is obliged to make payment within 7 calendar days from the date of conclusion of the contract. If payment is not made within this period, the sales contract is terminated.
  3. The Seller documents the sale with a receipt or a VAT invoice, in accordance with applicable tax regulations.

6. Delivery

  1. Deliveries are carried out by a courier company within the territory of Poland. The courier company does not provide a carrying service. In the case of pallet shipments, the courier leaves the Goods on the property; if this is not possible, the driver may drive to the nearest place where such delivery is possible. In such a situation, carrying the shipment is organized by the Client.
  2. The order lead time is up to 8 weeks, and in the case of mirrors up to 21 working days, counted from the date the payment is credited or the contract is concluded. The order lead time does not include the delivery time of the shipment by the courier company.
  3. After receiving the shipment, the Client should check its condition in the presence of the courier. If any damage is found, it is recommended to draw up a damage report.

7. Withdrawal from the contract

  1. The Consumer has the right to withdraw from a distance sales contract within 14 calendar days without giving any reason.
  2. The period for withdrawal begins on the day on which the Consumer or a third party indicated by the Consumer, other than the carrier, takes possession of the Goods.
  3. The declaration of withdrawal from the contract should be sent electronically to the following address: biuro@retrowood.pl, using the form available on the Online Store website.
  4. The address for returning the Goods will be sent by e-mail after receiving a correctly completed declaration of withdrawal.
  5. The Consumer is obliged to return the Goods without undue delay, no later than 14 days from the day on which they withdrew from the contract.
  6. The Seller refunds to the Consumer all payments received from the Consumer, including the cost of delivery (except for additional costs resulting from the Consumer’s choice of a delivery method other than the cheapest standard delivery method offered by the Seller), within 14 days from the day of receiving the returned Goods or proof of their dispatch, whichever is earlier.
  7. The Consumer bears the direct costs of returning the Goods.
  8. The Consumer is liable for any reduction in the value of the Goods resulting from using them in a manner beyond what is necessary to establish the nature, characteristics and functioning of the Goods.

8. Complaints and statutory warranty

  1. The Seller is liable under the statutory warranty for physical and legal defects of the Goods.
  2. Complaints may be submitted by e-mail using the complaint form available on the website.
  3. The Seller may request that the Goods be returned — the address will be provided by e-mail.
  4. For furniture made of reclaimed wood, discolouration, traces of nails, woodworms and cracks do not constitute grounds for a complaint.

9. Complaint procedure

  1. Complaints regarding services may be submitted exclusively by electronic means to the address: biuro@retrowood.pl.
  2. The Seller will consider the complaint within 14 calendar days.

10. Voucher redemption

  1. A Voucher is a value voucher issued by the Seller which enables the holder to make purchases in the Online Store.
  2. Vouchers are not personalized. Any person who has the code may use them.
  3. The validity period of a voucher is determined individually and communicated to the Client at the time of purchase.
  4. Several vouchers may be redeemed in a single order.
  5. Vouchers cannot be combined with other promotions or discounts.
  6. Vouchers are not refundable and cannot be exchanged for cash.
  7. Purchasing a voucher does not constitute the conclusion of a sales contract for Goods, but only the provision of funds for their later use.

11. Product reviews

  1. Reviews in the Online Store may be submitted only by Clients who have purchased a given Good.
  2. The Seller verifies whether a review comes from a person who actually made a purchase by comparing the data included in the review with the order data in the Seller’s system.
  3. Submitting a review is voluntary and free of charge.
  4. The Seller does not edit or delete reviews that comply with these Terms and Conditions.

12. Cookies

  1. The Online Store uses cookies to ensure the correct operation of the website, adapt it to the user’s preferences and to compile anonymous statistics.
  2. During the first visit to the Online Store, the Client is informed about the use of cookies and has the option to give or refuse consent to the storage of cookies on their end device.
  3. The user may change the cookie settings in their web browser at any time.
  4. More information about cookies can be found in the Privacy Policy available on the Online Store website.

13. Final provisions

  1. The Seller reserves the right to amend these Terms and Conditions. Any amendment will be published on the Online Store website at least 7 days before it comes into force. Orders placed before the effective date of the amendments are processed under the previous terms.
  2. In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law shall apply, including the Civil Code and the Act on Consumer Rights.
  3. Disputes arising in connection with the performance of the sales contract shall be settled by a court of competent jurisdiction in accordance with the provisions of the Code of Civil Procedure, and in the case of Consumers by the court having jurisdiction over their place of residence.
  4. The Consumer may use out-of-court dispute resolution methods, including mediation or the ODR (online dispute resolution) platform available at: https://ec.europa.eu/consumers/odr
